1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Kimberly Propertiees ("Company", "we", "us", or "our"), concerning your access to and use of the kimberlyfarms.in website as well as any other media form, mobile application, or Co-Farmer Portal related, linked, or otherwise connected thereto.

You agree that by accessing the Site or investing in Royal Kimberly, you have read, understood, and agreed to be bound by all of these Terms of Service.

2. Legal Capacity and KYC

By using the Site and booking a plot, you represent and warrant that: (1) all registration and KYC information you submit will be true, accurate, current, and complete; (2) you have the legal capacity to enter into binding agricultural land agreements in Karnataka; (3) you are not a minor in the jurisdiction in which you reside.

3. Land Purchases and Managed Farming

When purchasing a plot at Royal Kimberly:

• Plots are sold based on availability. Prices per square foot (e.g. ₹249/sq.ft) are subject to change before booking confirmation.
• The 15-year managed maintenance contract is executed independently of the land sale deed.
• All projected ROIs (e.g. ₹3 Crore+ returns) are based on current market rates directly tied to the State Government's Sandalwood valuation and are forward-looking estimates, non-guaranteed.
• Timber harvesting requires mandatory permissions from the Forest Department as per the Karnataka Forest Act, which Kimberly Propertiees facilitates.

4. Co-Farmer Portal Access

Upon successful registration of your plot, you will be granted access to the Co-Farmer Portal. You are responsible for keeping your password confidential. Kimberly Propertiees reserves the right to remove, reclaim, or change a username you select if we determine it is inappropriate or violates our policies.

5. Resort Amenities Usage

Lifetime membership to clubhouse, pool, and glamping sites is provided to the primary registered plot owner and their immediate family. Usage rules and booking limits (via the Dashboard) apply to ensure fair access for all Co-Farmers.

6. Governing Law

These conditions are governed by and interpreted following the laws of India, and the use of the site implies your consent that the courts of Bengaluru, Karnataka, shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
